EU adds six battery exemptions | Wearables still require professional replacement

EU battery rules have gained six rare new exemption categories. On July 14, the European Commission adopted a delegated act that includes smartwatches and fitness trackers, removing the requirement that consumers be able to replace their portable batteries themselves. MacRumors reported that Apple Watch, AirPods, and Meta smart glasses fall within the covered categories.

The exemption does not remove the replaceability requirement. Qualifying small batteries must still be removable and replaceable by independent professionals. The Commission document said miniaturization can leave batteries tightly enclosed; professional-only replacement is permitted when removal creates a clear risk of damage or puncture, or when anatomical or ergonomic constraints hinder redesign.

The EU Batteries Regulation generally requires products sold in the bloc with portable batteries to let consumers replace them, extending product life and aiding collection for recycling. Medical devices and wet appliances such as electric toothbrushes already have safety exemptions. The expanded list also covers electric toys and equipment governed by the ATEX Directive for potentially explosive atmospheres.

The delegated act has not completed the legislative process. It has been sent to the European Parliament and the Council of the EU for scrutiny. If neither objects, it will enter into force 20 days after publication in the Official Journal of the European Union.
