xAI has filed one of the first federal cases in which an AI company sued its own user over alleged generation of child sexual abuse material. The company sued South Carolina resident Terry Wayne Harwood in federal court in Texas on July 14, alleging that he violated its terms, bypassed Grok safeguards, and turned nonsexual images of adults and minors into explicit deepfakes. These are allegations in a civil complaint, and the court has not ruled on them.
The complaint says Harwood “knowingly and intentionally” used Grok to generate and distribute CSAM and made nonconsensual sexual imagery of adults. xAI also alleges that “at least some” images tied to Harwood's criminal case were generated or altered with Grok. The company seeks unspecified damages, related legal expenses, and a permanent order barring Harwood from creating an xAI account or using Grok.
The South Carolina Attorney General's Office says Harwood was arrested on February 26 and charged with three second-degree and five third-degree counts of sexual exploitation of a minor, each carrying up to 10 years in prison. The eight criminal charges are separate from xAI's civil case. Prosecutors say Harwood is presumed innocent unless convicted.
